Taking a wellness brand through examination

A wellness business needed trade mark protection reflecting several parts of its offering.

Client names and identifying details have been omitted. This account describes the work and stage stated below.

The business and background

The client operated a wellness business whose activities extended across several service areas, including wellness services, accommodation and related commercial activities. It wanted UK protection for a logo incorporating its brand name. The application needed to identify the relevant services clearly and reflect the business’s offering. During examination, the UKIPO queried parts of the specification, requiring the client to consider amendments without losing sight of the protection it wanted.

The challenge

The proposed services crossed several areas, and some descriptions needed clarification during examination.

Our approach

We prepared a multi-class application and addressed the examiner’s specification queries. The amendments clarified an accommodation service and removed descriptions that were too vague, with the client’s agreement.

Work and outcome

The application proceeded to registration following the agreed amendments. The registration concerned the submitted logo mark; it should not be described as a separate registration of the word alone.

What this illustrates

A useful application combines appropriate coverage with wording that clearly identifies the goods and services.
