Building an evidence-led response to a name dispute

An established professional-services business faced a dispute involving a similar name.

Client names and identifying details have been omitted. This account describes the work and stage stated below.

The business and background

The client was an established professional-services business with a history of trading under its name. A dispute with another business using a similar identity raised questions about earlier trading, goodwill, trade mark rights and company names. The client needed those issues brought together in a coherent response. Our instruction included reviewing the allegations, assembling the supporting history and corresponding with the other side’s representatives.

The challenge

The business needed its trading history and goodwill to be explained alongside the relevant trade mark and company-name issues.

Our approach

We reviewed the allegations, requested supporting records and prepared substantive correspondence. The work also addressed practical transition proposals during negotiations.

Work and outcome

The completed work described here is evidence review, response correspondence and negotiation. This is not presented as a final court ruling or completed settlement.

What this illustrates

Records showing when and how a name has been used can be central to assessing a commercial dispute.
