Assessing protection for a community identity

A community organisation raised concerns about another group’s use of a similar identity online.

Client names and identifying details have been omitted. This account describes the work and stage stated below.

The business and background

The client was a community organisation concerned about another group’s use of a similar identity online. It supplied screenshots and historical social-media material to support its position. The other group put forward its own explanation of the name and claimed earlier use. Our instruction required consideration of both the client’s registered rights and the competing accounts of how the identities had developed.

The challenge

The dispute required consideration of trade mark rights, historical use and the evidence of alleged confusion.

Our approach

We reviewed screenshots and earlier social-media material and advised on the chronology. Following instructions, correspondence was sent setting out the client’s position.

Work and outcome

Advice and enforcement correspondence were provided. Competing accounts of prior use remained issues to assess; this study does not claim a finding of infringement.

What this illustrates

Online enforcement should be grounded in the available rights and evidence, including the other party’s account of earlier use.
